§ 1 Scope
(1) These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between sellers and buyers via the online marketplace slipcherie (hereinafter "Platform").
(2) The Platform is operated by Patrick Steinhaus, Schänkenweg 13, 01109 Dresden (hereinafter "Operator").
(3) The Operator acts exclusively as an intermediary. Purchase contracts are concluded exclusively between sellers and buyers.
§ 2 Registration and User Account
(1) Use of the Platform requires registration. By registering, the user agrees to these GTC.
(2) The user is obligated to provide truthful information during registration and to keep it up to date.
(3) Users must be at least 18 years old. The Operator reserves the right to request proof of age.
(4) Each user may only maintain one account. The Operator reserves the right to block or delete multiple accounts.
§ 3 Sellers
(1) Natural persons who have reached the age of 18 may register as sellers.
(2) Sellers are solely responsible for compliance with all applicable laws and regulations, particularly with regard to taxes and duties.
(3) Sellers are obligated to describe their items truthfully and completely. Misleading information is prohibited.
(4) The seller grants the Operator a simple, transferable right of use to all content uploaded by the seller (images, texts, videos) for the purpose of operating the Platform.
§ 4 Buyers
(1) Natural persons who have reached the age of 18 may register as buyers.
(2) Buyers may choose from various delivery and payment options when placing an order, insofar as offered by the seller.
§ 5 Conclusion of Contract
(1) The display of items on the Platform does not constitute a legally binding offer, but rather an invitation to place an order.
(2) By submitting an order, the buyer makes a binding offer to purchase the item.
(3) The purchase contract is concluded when the seller accepts the order. Acceptance may be made expressly or by shipping the item.
§ 6 Prices and Payment
(1) All prices stated on the Platform are final prices including statutory value-added tax (where applicable).
(2) Shipping costs, if applicable, are shown separately and are to be borne by the buyer.
(3) Payment is made via the payment methods offered on the Platform. The Operator receives the payment on behalf of the seller and forwards it to the seller after deducting the commission.
(4) The Operator's commission is 30% of the selling price (excluding shipping costs).
§ 7 Delivery
(1) Delivery is made by the seller to the delivery address provided by the buyer.
(2) For consumers, the seller bears the shipping risk.
§ 8 Prohibited Content and Conduct
The following is prohibited:
- Offering or purchasing items that violate applicable law
- Publishing content that is harmful to minors, glorifies violence, is racist, or is otherwise unlawful
- Using the Platform to initiate contact outside of the intended functions
- Harassing, threatening, or insulting other users
- Providing false or misleading information
- Manipulating or impairing the technical infrastructure of the Platform
§ 9 Liability
(1) The Operator is not liable for legal defects or material defects of items sold via the Platform. Liability rests with the respective seller.
(2) The Operator is liable for damages only in cases of intent or gross negligence. Liability for slight negligence is limited to the breach of essential contractual obligations.
(3) The above limitations of liability do not apply to damages arising from injury to life, body, or health.
§ 10 Dispute Resolution
(1) The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/
(2) We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
§ 11 Data Protection
The processing of personal data is carried out in accordance with our privacy policy, which is available at /datenschutz.
§ 12 Amendment of the GTC
(1) The Operator reserves the right to amend these GTC at any time with effect for the future.
(2) Amendments will be communicated to users by email or upon next login. If the user does not object within four weeks of receiving the amendment notification, the amended GTC shall be deemed accepted.
§ 13 Final Provisions
(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be the Operator's place of business.
(3) Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.
